(a) Article 124A
(b) Article 216A
(c) Article 224A
(d) Article 274A
Ans (c)
The Supreme Court on April 19, 2021 passed a slew of guidelines regarding the appointment of ad-hoc judges in High Courts under Article 224A of the Constitution. A bench comprising Chief Justice of India SA Bobde, Justices Sanjay Kishan Kaul and Surya Kant passed the judgment in the case Lok Prahari vs Union of India. Article 224A enables a Chief Justice of a High Court, with the previous consent of the President, to request a former High Court judge to “sit and act as a judge” of the High Court to hear cases. The provision has been invoked very rarely in the judicial history of India. The Supreme Court has laid down 5 trigger points which can activate the process under Article 224A. The Trigger Point cannot be singular and there can be more than one eventuality where it arieses: 1. If the vacancies are more than 20% of the sanctioned strength. 2. The cases in a particular category are pending for over five years. 3 .More than 10% of the backlog of pending cases are over five years old, 4. The percentage of the rate of disposal is lower than the institution of the cases either in a particular subject matter or generally in the Court, 5. Even if there are not many old cases pending, but depending on the jurisdiction, a situation of mounting arrears is likely to arise if the rate of disposal is consistently lower than the rate of filing over a period of a year or more.

Now, it has been decided to dispense with this requirement. A person who has got registration as OCI cardholder prior to attaining the age of 20 years will have to get the OCI card re-issued only once when a new passport is issued after completing 20 years of age. If a person has obtained registration as OCI cardholder after attaining the age of 20 years, there will be no requirement of re-issue of OCI card. As per the extant law, a foreigner of Indian origin or a foreign spouse of an Indian citizen or foreign spouse of an Overseas Citizen of India (OCI) cardholder, can be registered as an OCI cardholder.
