What is Places of Worship Act 1991? (Hindi&English)

Why in the news?

The five member Constitution Bench of the Supreme Court in the Babri Masjid-Ram Janmabhoomi dispute, observed that the said act has preserved the constitutional value of secularism by not permitting the status of a place of worship to be changed.

What does the act mean?

The Places of Worship Act 1991 was passed during the first year of the P.V. Narasimha Rao government in September 1991. The Act declares that the religious character of a place of worship shall continue to be the same as it was on August 15, 1947. It says no person shall convert any place of worship of any religious denomination into one of a different denomination or section. The disputed site at Ayodhya was exempted from the Act. Section 6 mandates a three-year “imprisonment and a fine for contravening the provisions of Section 3”.

The provisions of the act do not apply to ancient and historical monuments and archaeological sites and remains that are covered by the Ancient Monuments and Archaeological Sites and Remains Act, 1958. (The Hindu and The Print)

‘उपासना स्थल एक्ट 1991’

‘उपासना स्थल एक्ट 1991’ तत्कालीन प्रधानमंत्री श्री नरसिम्हा राव के प्रधानमंत्रित्व काल में 1991 में पारित किया गया था। इस एक्ट में यह प्रावधान है कि किसी उपासना स्थल का धार्मिक स्वरूप वैसा ही रहेगा जैसा कि 15 अगस्त, 1947 को था। इसके पश्चात दायर सभी मुकदमों को समाप्त मान लिया गया। हालांकि इससे पहले दायर मुकदमों पर यह एक्ट नहीं लागू होता। इसलिए रामजन्मभूमि-बाबरी मस्जिद इस एक्ट के दायरे में नहीं आता। उन ऐतिहासिक स्मारकों एवं पुरातत्व स्थलों पर भी यह एक्ट नहीं लागू होता है जो प्राचीन स्मारक एवं पुरातत्व स्थल एवं पुरावशेष एक्ट 1958 के तहत मान्यता प्राप्त हैं।
