CBI not completely exempt from purview of RTI Act: Delhi High Court

The Delhi High Court has ruled that the CBI is not completely exempt from the purview of the RTI Act, and the act permits it to provide information pertaining to corruption and human rights violations.

  • The proviso to Section 24 permits information pertaining to allegations of corruption and human rights violation to be made available to the applicant and the same cannot be included in the exception provided to organisations mentioned in the Second Schedule of the RTI Act.
  • As per Section 24, the act shall not apply to the intelligence and security organisations specified in the Second Schedule, however, the information pertaining to the allegations of corruption and human rights violations shall not be excluded under this sub-section.
  • Second Schedule of the RTI Act includes Intelligence and security organisation established by the Central Government.
